NEXT EVENTS & FESTIVALS (PTY) LTD
(Applicable to Tickets, Exhibitors, Participants and Challenges)

1. Acceptance of Terms

By purchasing a ticket, registering for or participating in any challenge, submitting an exhibitor application, making payment, entering an event venue, or otherwise engaging with any event organised by NEXT Events & Festivals (Pty) Ltd, including World Sports South Africa (WSSA), you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms and Conditions. If you do not agree, you must not proceed with any purchase, registration, or participation.

2. Definitions and Scope

“NEXT Events” refers to NEXT Events & Festivals (Pty) Ltd and all affiliated brands, platforms, and events, including World Sports South Africa (WSSA), NEXT Fitness Challenge, and NEXT Outdoor Activities Challenges.
“Event” refers to any exhibition, festival, sports event, challenge, activation, or related activity organised or hosted by NEXT Events in Cape Town, Gauteng, Durban, or any other location.
“Ticket Holder” refers to any person who has purchased or received a ticket.
“Exhibitor” refers to any individual or entity approved to trade, display, activate, or exhibit at an Event.
“Participant” refers to any individual or entity participating in a fitness challenge, sports challenge, or activity, whether competitively or recreationally.

These Terms apply to all Ticket Holders, Exhibitors, Participants, affiliates, coaches, teams, partners, and attendees, without exception.

3. Nature of Events and Challenges

All Events and challenges are participation-based and are not professional sporting competitions. Participation is voluntary and undertaken entirely at the Participant’s own risk. NEXT Events makes no guarantees regarding performance outcomes, rankings, results, prizes, personal improvement, or experience quality.

Participants confirm that they are physically and medically fit to participate and understand that activities may involve physical exertion, equipment use, interaction with other participants, venue infrastructure, weather exposure, and inherent risks.

4. Tickets, Registration and Entry

All tickets, registrations, and exhibitor stands are issued and managed solely by NEXT Events and are valid only for the specific Event, date, and location confirmed at the time of purchase or approval, unless otherwise reallocated by the Organiser.

Entry and participation remain subject to venue capacity, safety requirements, age restrictions where applicable, and compliance with all Event rules. NEXT Events reserves the absolute right to refuse entry, revoke tickets, or terminate participation without compensation where there is misconduct, rule breaches, safety concerns, or non-compliance.

5. Exhibitors

Exhibitor participation is subject to written approval, compliance with exhibitor rules, venue regulations, and all applicable laws. No unauthorised selling, marketing, or flyering is permitted outside approved exhibitor areas.

Exhibitors are responsible for their own stock, equipment, structures, staff, permits, and insurance. NEXT Events accepts no responsibility for exhibitor losses, damages, or operational interruptions.

No camping, overnight stays, or unauthorised storage is permitted on venue grounds unless expressly approved in writing.

6. Fees, Payments and Non-Refundable Policy

All ticket sales, exhibitor fees, participation fees, and related payments are final, payable in full, and non-refundable to the fullest extent permitted by South African law.

Event postponement, rescheduling, relocation, format changes, or programme adjustments do not constitute cancellation and do not entitle any person to a refund. Tickets, exhibitor bookings, and participation rights will carry forward to the rescheduled Event.

At the sole discretion of NEXT Events, bookings may be transferred to another NEXT Event within the same calendar cycle or credited toward a future Event. No obligation exists to offer refunds, transfers, or credits unless required by law.

7. Event Changes and Force Majeure

NEXT Events reserves the right to modify Event dates, venues, layouts, schedules, challenge formats, safety protocols, programming, and participants at any time for operational, safety, regulatory, commercial, or logistical reasons.

NEXT Events shall not be liable for delays, postponements, cancellations, or changes caused by circumstances beyond its control, including extreme weather, natural disasters, pandemics, strikes, power failures, venue restrictions, or government action. Such events do not give rise to refunds or claims.

8. Conduct, Safety and Compliance

All Ticket Holders, Exhibitors, and Participants must comply with Event rules, safety instructions, venue regulations, and directions from Event staff.

NEXT Events may immediately remove or exclude any person for intoxication, harassment, unsafe behaviour, vandalism, cheating, abusive conduct, or failure to comply with health and safety requirements, without refund or compensation.

9. Intellectual Property

All Event names, challenge formats, layouts, branding, logos, concepts, and intellectual property remain the exclusive property of NEXT Events. No reproduction, imitation, commercial use, or exploitation is permitted without prior written consent.

10. Media and Image Rights

By attending, exhibiting, or participating, you grant NEXT Events an irrevocable, perpetual, royalty-free right to photograph, film, record, and use your image, likeness, voice, and participation for marketing, promotional, broadcast, and reporting purposes, without compensation.

11. Liability, Risk and Indemnity

Attendance and participation occur entirely at your own risk. To the fullest extent permitted by law, NEXT Events, its directors, employees, contractors, and partners shall not be liable for any injury, illness, death, loss, theft, damage, or financial loss arising from or connected to any Event, except where caused by proven gross negligence.

All Participants and Exhibitors indemnify and hold harmless NEXT Events against any claims, losses, damages, or liabilities arising from their actions, participation, or breach of these Terms.

12. Insurance

Exhibitors are required to maintain adequate public liability, stock, and equipment insurance. Participants and Ticket Holders are responsible for their own personal insurance and belongings at all times.

13. Privacy and Data Protection

Personal information is processed in accordance with the Protection of Personal Information Act (POPIA). Data is used solely for legitimate Event administration, safety, communication, and marketing purposes and will not be sold to unrelated third parties.

14. Termination

NEXT Events may terminate or suspend any ticket, exhibitor agreement, or participation without refund where these Terms are breached. Termination does not limit any rights or remedies available to NEXT Events.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall first be addressed through good-faith discussions and mediation in Cape Town or Johannesburg. Failing resolution, the High Court of South Africa shall have jurisdiction.

16. General

These Terms constitute the entire agreement between the parties. If any provision is found unenforceable, the remaining provisions remain valid. NEXT Events reserves the right to amend these Terms at any time, with updated versions applying to future participation.
